Welcome to Kolkol!

Your use of Kolkol is subject to these Terms of Service (these “Terms”). Thank you for reviewing these Terms - we hope you enjoy using Kolkol.

1 General

We reserve the right to change these Terms of Service at any time. We will notify you within the app. You are responsible for keeping yourself appraised of any such changes if you dismiss these notifications. If you object to any Terms of Service or any subsequent changes or you become dissatisfied with our Services in any way, your only option is to delete your account. Your continued use of our Services after we post revised Terms of Service means that you agree to the revisions. You must be at least 18 years old to download our Services. By requesting to use, or using our Services, you represent and warrant that you are not required to register as a sex offender with any government entity.

Our Services are free, but your Internet provider’s or mobile operator’s fees and rates may still apply.

However, we do have in-app purchases that you can buy if you want to use some of our extra features.

2 Registration and Access

You will need to create an account with us in order to access and use Kolkol via using your existing account opened at third party social media platforms (such as Facebook or Google). We will have the right to access, collect and use your information relating to these third party accounts.

Any account that you open with us is personal to you and you are prohibited from gifting, lending, transferring or otherwise permitting any other person to access or use your account. Your account name, user ID and other identifiers you adopt within Kolkol remains our property and we can disable, reclaim and reuse these once your account is terminated or deactivated for whatever reason by either you or us.

You are responsible for: (i) safeguarding your account details, including any password used to access your account and Kolkol, and (ii) all use of Kolkol under your account. You must promptly notify us at zoropad2@gmail.com if you know or suspect that your password or account has been compromised. We will regard all use of your account on Kolkol as being by you, except where we have received and acknowledged your notification to us regarding your account/password being compromised.

Kolkol may offer methods for deactivating your service-specific account – please refer to Kolkol for further guidance (if available) from time to time.

Please note that when you login as a visitor, there is always a risk of loss of both your account and any interests linked with the account, such as gold coins you prepaid. Therefore, we highly recommend you login through Facebook or Google account, to avoid any risk of loss of information and gold coins.

3 Your Content on Kolkol

Kolkol does NOT claim ANY ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you post on or through the Kolkol Services. By displaying or publishing ("posting") any Content on or through the Kolkol Services, you hereby grant to Kolkol a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels, except Content not shared publicly ("private") will not be distributed outside the Kolkol Services.

You represent and warrant that: (i) you own the Content posted by you on or through the Kolkol Services or otherwise have the right to grant the license set forth in this section, (ii) the posting and use of your Content on or through the Kolkol Services does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the posting of your Content on the Site does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of Content you post on or through the Kolkol Services.

The Kolkol Services contain Content of Kolkol ("Kolkol Content"). Kolkol Content is protected by copyright, trademark, patent, trade secret and other laws, and Kolkol owns and retains all rights in the Kolkol Content and the Kolkol Services. Kolkol hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the Kolkol Content (excluding any software code) solely for your personal use in connection with viewing the Site and using the Kolkol Services.

The Kolkol Services contain Content of Users and other Kolkol licensors. Except as provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Kolkol Services.

Kolkol performs technical functions necessary to offer the Kolkol Services, including but not limited to transcoding and/or reformatting Content to allow its use throughout the Kolkol Services.

Although the Site and other Kolkol Services are normally available, there will be occasions when the Site or other Kolkol Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Kolkol. Also, although Kolkol will normally only delete Content that violates this Agreement, Kolkol reserves the right to delete any Content for any reason, without prior notice. Deleted content may be stored by Kolkol in order to comply with certain legal obligations and is not retrievable without a valid court order. Consequently, Kolkol encourages you to maintain your own backup of your Content. In other words, Kolkol is not a backup service. Kolkol will not be liable to you for any modification, suspension, or discontinuation of the Kolkol Services, or the loss of any Content.

4 DOS AND DON'TS

Allow to do:

• comply with all applicable laws, including privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
• strictly follow these Terms;
• and use Kolkol in a good manner.

Not Allow to do:

• impersonate any person or entity.
• solicit money from any users.
• harm, stalk or otherwise harass another.
• impersonate, or misrepresent your relationship with, any person or entity (this includes pretending to be minor if you are not)
• upload or transmit any Content that you do not have a right to make available, or that infringes any patent, trademark, trade secret, copyright, privacy, or other proprietary rights of any party.
• express or imply that any statements you make are endorsed by us without our specific prior written consent.
• use the Service in an illegal manner or to commit an illegal act.
• access the Service in a jurisdiction in which it is illegal or unauthorized.
• ask or use users to conceal the identity, source, or destination of any illegally gained money or products.
• use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
• upload or transmit software viruses or any other harmful computer code, files or programs, or use any data mining, robots, or similar data gathering or extraction methods.
• collect usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Service.
• interfere with or disrupt the Service or the servers or networks connected to the Service.
• transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service (either directly or indirectly through the use of third-party software).
• “frame” or “mirror” any part of the Service, without our prior written authorization.
• use meta tags or code or other devices containing any reference to our Services or the Service (or any trademark, trade name, service mark, logo or slogan of our Services) to direct any person to any other mobile application and website for any purpose.
• modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service any software used on or for the Service, or cause others to do so.
• post, use, transmit or distribute directly or indirectly (e.g. screen scrape) in any manner or media any content or information obtained from the Service other than solely in connection with your use of the Service in accordance with this Agreement.
• register accounts or post Content automatically, systematically, or programmatically.
• create unnecessary amounts of accounts. If we determine you have created various accounts to spam, misinterpret, or for any other malicious reasons we reserve the right to terminate your account without notice.

1. Prohibition on Child Sexual Abuse and Exploitation

• Strict Prohibition: We strictly prohibit any form of child sexual abuse and exploitation on our platform. This includes but is not limited to the creation, distribution, transmission, storage, or display of any content that sexually exploits minors or engages in child sexual abuse.
• User Conduct: Users of Kolkol must not engage in any activity that violates the rights of children or promotes child sexual exploitation. This includes, but is not limited to, sharing, posting, or soliciting any material that depicts minors in sexually explicit conduct.
• Reporting Mechanism: We have implemented a robust reporting mechanism for users to report any content or behavior that they believe may violate this policy. Upon receiving a report, we will take immediate action to investigate and remove any offending content, and may involve law enforcement as necessary.
• Account Termination: Any user found to be in violation of this policy will be subject to immediate termination of their account and all associated privileges. We reserve the right to take any further action we deem appropriate, including reporting the user to the relevant authorities.
• Compliance with Laws: Users must comply with all applicable laws and regulations regarding the protection of minors, including but not limited to the Children's Online Privacy Protection Act (COPPA), and other international laws against child exploitation.
• Monitoring and Enforcement: We actively monitor our platform to detect and prevent any form of child sexual exploitation. We utilize automated systems and human moderation to enforce this policy and protect the safety of all users, especially minors.
• Education and Awareness: We are committed to raising awareness about the dangers of child sexual exploitation and work to educate our users about the importance of reporting any suspicious content or behavior.
• Collaboration with Authorities: We cooperate fully with law enforcement agencies and other organizations dedicated to combating child sexual exploitation. This includes providing assistance in investigations and taking action against users who violate this policy.
• Updates to Policy: We reserve the right to update this policy at any time to reflect changes in laws, regulations, or our commitment to combating child sexual exploitation. Users are responsible for staying informed about the current policy.
• User Responsibility: Each user is responsible for their own conduct and for ensuring that their activities on our platform comply with this policy and all applicable laws.

5 Payments

You may, from time to time, make payments to us or third parties as part of your use of Kolkol (including for the provision of Kolkol or provision of certain additional features within Kolkol). We may set out further terms applying to such payments (including in relation to refunds (if any), billing arrangements and any consequences of failing to make timely payments). You must comply with all such terms in relation to your payments to us. You agree that you are solely responsible for all fees and taxes associated with any such payments, and that pricing and availability of items and products are subject to change at any time.

We may process payments from you in Kolkol via a third party service and you agree to comply with that relevant third party's terms and conditions in relation to the payment processing service, as further set out in the “Third Party Content and Services” section below.

Also, you agree that:

• your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates);
• we may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.

6 Eligibility

The Software and Services are intended solely for users who are eighteen (18) years of age (collectively, "Age of Consent"), or older, and any registration, use or access to the Software or Services by anyone under the Age of Consent is unauthorized, unlicensed, and in violation of the Terms of Use. By accessing or using the Software or Services, you represent and warrant that you: (i) are over the Age of Consent or over the legal age of majority under applicable law in the jurisdiction in which you reside or in the territory of your citizenship; (ii) have the legal power to form a binding contract with Kolkol; and (iii) are physically located in a jurisdiction in which the use of the Software and Services is permitted by law. Kolkol may terminate your account at any time delete any content or information you have submitted, and prohibit you from using the Software or Services, if it has any reason to believe that you are under the age of majority in your jurisdiction, or that the Software or Services are prohibited in your jurisdiction.

7 Termination

If you violate the Terms, or otherwise create risk or possible legal exposure for us, then we reserve the right at our sole discretion, at any time and without liability or the need to give you prior notice or to refund any unused services to:

Suspend or revoke your registration (where applicable) and your right to access and/or use Kolkol or submit any Content to Kolkol;

Make use of any operational, technological, legal, or other means available to enforce the Terms (including without limitation blocking specific IP addresses).

We will try (but we are not obliged) to notify you if your access to Kolkol and/or your Profile is to be or has been suspended or terminated.

If you have registered on Kolkol, you can terminate your registration at any time by going to the "Settings" control on Kolkol when you are logged in and choosing the "Delete Account" link.

8 Safety and Security

We do not currently conduct criminal background screenings on our Members. We reserve the right, however, to conduct any criminal background check we deem appropriate, at any time and using available public records. By agreeing to these Terms of Service, you hereby authorize any such check.

You are responsible for maintaining the confidentiality of the username and password you designate during the registration process, and you are solely responsible for all activities that occur under your username and password. You agree to immediately notify us of any disclosure or unauthorized use of your username or password or any other breach of security at zoropad2@gmail.com and ensure that you log out from your account at the end of each session.
